1) General Conditions : We,roomsandcars.com ("The Company"), accept all the bookings for the products which are
shown in this website under the following terms and conditions, and by booking with us you
will be accepting the terms and conditions and abide by them. The Company acts as a booking
agent, for all the products in this website, and that your contract is with the
supplier(s) (e.g. hotel supplier or the car hire company) concerned. Any booking made or
order placed by you, whether through the Company's website or otherwise, shall be deemed
an offer by you to purchase the relevant product subject to these booking conditions. No
contract between you and the Company shall come into existence until the Company accepts
full payment and issues a confirmation invoice. All contracts with the Company and all
matters arising from them are subject to English law and to the exclusive jurisdiction of
the courts of England and Wales. The person who makes the booking accepts these conditions
on behalf of all members of the party and is responsible for all payment due from the party.
Booking services with the company are currently only available to persons who are at least
18 years old. By submitting a booking you warrant and confirm to us that you comply with
those arrangements. We do not sell or offer for sale any "packages" or act as an
"organiser" within the meaning of the Package Travel, Package Holidays and
Package Tours Regulations 1992 and these Regulations do not apply to any booking
you may make. References to "you" and "your" in these Booking Conditions mean
all persons named on the booking (including anyone who is added or substituted
at a later date). "We" "us" and "our" mean RoomsAndCars.com. All communications
relating to your booking must be sent to us by email by the party leader quoting
the booking reference.
2) Contract :
To confirm a booking, the party
leader must be authorised to make the booking on the basis of these Booking
Conditions by all persons named on the booking and their parent or guardian for
all party members who are under 18 when the booking is made. By making the
booking, the party leader confirms that he/she is so authorised. The party
leader is responsible for making all payments due to us. The party leader must
be at least 18 when the booking is made.
Once we have received your booking and all appropriate payments, we will, email
the party leader a confirmation for the requested bookings within 24 /48 hours
within which time we also reserve the right to refuse any bookings without prior
notification or having to give any reason, or inform the party leader of non
availability of the requested booking in which case we will do our best to
present you with an alternative subject to avalability of any. Please
check any invoice/confirmation carefully as soon as you receive it. Contact us
immediately if any information which appears on the invoice/confiramtion or any
other document appears to be incorrect or incomplete as it may not be possible
to make changes later. As we act only as agent we will have no responsibility
for any errors in any documentation except where those errors were made by us.
Subject to this, we regret we cannot accept any liability if we are not notified
of any inaccuracy in any document within 14 days of our sending it out. We will
do our best to rectify any mistake notified to us outside these time limits but
you must meet any costs involved in doing so. The only exception to this
requirement to meet costs is where the mistake in question was made by us and
there is good reason why you did not tell us about it within these time limits.
A binding contract between you and the principal concerned comes into existence
only when we send your retail sales invoice/confirmation on the principals's(s')
behalf to the party leader and the terms and conditions of the principal, in
addition to these conditions, will be applicable to the contract. Any request
for a group booking, to cover the cost of arranging a Group Booking, we reserve
the right to charge a fee. You will be told how much the fee is before you book
and the fee will be calculated on a booking by booking basis.
3) Payments Terms and Methods:
Full method of payment for all products including promotional are required at the time of booking
regardless of the product arrangements being confirmed. In the case of credit or
debit cards no charge will be made until the booking is definately confirmed or
in the event that other payment method being used and the we are
unable to obtain confirmation and cannot offer an alternative, a refund will be issued.
We will not accept responsibility for cash sent through the post. We
reserves the right to pass on any charges relating to returned cheques and credit card
charge back. Taxes do fluctuate in line with exchange rates and will be recalculated on
the day payments are collected. You will be advised if additional monies
are due. We strongly recommend that all documents be sent to you by Registered Post or
Courier Service to your home, office for an additional fee. Documents can be mailed by
First Class post, but the we will not accept responsibility for documents mislaid
or lost by the Royal Mail, although the we will do its best to assist in this
circumstance, and in many cases the email confirmation will be sufficient.
3.1) Payment Methods For UK residents :
At the moment we are quite restricted in the ways
we can accept your payments, we are very sorry for this inconvenience we are
working towards sorting this out as soon as possible. The ways in whic we can
accept your (UK residence) payments are as follows.
3.1.1) Credit / Debit Cards :
All accepted Credt/Debit card payments are
processed by the worlds most secure and efficient payment systems in the world,
it is processed by PayPal
on their servers. All credit and debit card
payments submitted to ourselves will be processed in this way. All payments
processed in this way are subject to PayPal terms and conditions as well as
ours. There is a charge for credit
card payments of 2%, and no charge is applicable to debit card payments. If
credit card is your choice of payment then the 2% will be added to the total.
All processed monies and charges will be made in GBP.
3.1.2) Cash Over The Counter :
You can make a payment over the cashier counter of any Bank of Scotland or some Halifax Branches. You will need our account details for this which we can provide you with upon written request. There will be no charges for this sort of transaction, and is the easiest and cleanest form of payment as it is cleared funds straight away.
3.1.3) Bank Transfer or Telephone Banking :
This sort of payment is very popular, all you do is pass our account details to your bank and ask them to make a payment into this account or you can (some banks) make online payment through your bank like paying a bill. You will have to speak to your bank for any charges which might apply for this sort of transaction. Be aware this sort of transaction takes 3/5 working days to clear, hence it is no good for people who need our products within a week
of booking at least. 3.1.4) Bankers Draft :
This is a payment method which your bank writes out their own cheque to cover the amount and ofcourse it comes out of your account immediately. Some banks charge for this service, please enquire with them for any potential charge. This method could take upto 3 working days to clear, hence again not good for people using our products within 7 days of booking. If you prefer this method please get your bank to make the cheque payable to "Rooms And Cars".
3.1.5) Personal Cheques :
You can also send us your own cheques. No charge is made by your bank for this sort of transaction (unless otherwise stated by your bank). You can make the cheque payable to "Rooms And Cars". This sort of transaction will take upto 10 working days to clear, hence not good for people thinking of using the products within 14 days of making the booking.
3.1.6) Pay Pal (Traditional):
This is the most popular online payment scheme. After booking provisionally, we will send you an email requesting payment for the amount due via the PayPal website. This is a secure server website. You will then have to register with PayPal (if you are not already registered) through their instruction on this email which could take 10 minutes of your time, but you can then use it to make payments anywhere in the world in any currency. This website will allow you to use any credit card, after verifying you as the card holder. There is a charge for this type of payment of 2%, If this is your choice of payment then the 2% will be added to the total. The actual charge by PayPal is 4% for this, which they don't charge the buyer (yourselves) but charges the seller (us), hence we feel it is only right for you to share that charge with us, so we half the charge, and you pay that (2%) as a surcharge. Once registered and verified you then just follow their easy stepto make payment. You can then use this payment method for anything, anywhere and any currency.Although you can pay any currency, we would require to pay our products with £ (Pound Sterling).
3.2) Payment Methods For Overseas Residence :
Please note all payments, which ever method used, must be made in GBP(£) , we are very sorry but at present we cannot accept any other currency. We are very sorry if any of the below methods or the fact that we cannot accept any other currency inconveniences you. The ways in whic we can accept your (UK residence) payments are as follows.
3.1.1) Credit / Debit Cards :

This is an electronic tranefr of funds between banks around the world. Your bank may charge for this transaction (please see their charges). In this transaction you give our account details to your bankers (anywhere in the world) and they transfer the funds straight into our account. Best, quickest and safest mode of tranfering funds across the world. The funds will take upto 3 days to clear, hence this method is not good for people wanting to use our products within a week of the booking.
3.1.3) Bankers Draft :
You could ask your bankers to write their own cheque by taking the money out of your account. There will be a charge for this transaction (please see their charges), but the cheque has to be in Pound Sterling (GBP £), and no other. This will take upto 10 working days from the day we submit it to our bankers for clearence, hence only good for people wanting to use our products for the future.
3.1.4) Personal Cheques :
We can accept your perosnal cheque too. But the cheque has to be in Pound Sterling (GBP £) and can take up to 10 working days after we submit it to our bankers for clearence for it to clear, hence only good for people wanting to use our products for the future.
3.1.5) PayPal :

method can be accepted, please do not offer.
4) Deposits :
As we are the acting agents for the principle, we
are sorry but we cannot accept a deposit or part payment towards anything we
quote or reserve for. All monies owed towards a booking will be requested in
full on reservation, as the principles only provide availability for definate
bookings hence once confirmation is requested from the principle they will see
this as a definate booking and their cancellation charges will apply.
5) Fees : We reserve the rights to charge a booking fee not exceeding £20 per booking
if the amount due for the products is less than £300. We also reserve the right to charge
booking fee not exceeding £20 per booking towards any car hire less than 7 days (7 x 24 hours).
We also
reserves the right to charge a booking fee not exceeding £20 per booking if the hotel room is required
for or less than 7 nights. The above booking fees will be charged without prior notice, as on booking
the products we will assume you have read these terms and conditions and accept the relevant payments. The
company also reserves the rights to charge any other necessary charge, of this you will be notified
and be asked to authorise such payments.
6) Documentation :
On receiving your payment you will be issued by email a temporary confirmation
and temporary reference for your booking, but confirmation is only valid on the
funds clearing before travel date. If the funds you have sent does not clear or
does not clear in time, the confirmation issued and reference number given will
be null and void. If the funds we receive is cleared funds (ie., cash), or when
the funds you forward sent clears you will then be issued with a hotel voucher,
tour vouher or a car hire voucher and a confirmation stating your booking is now
confirmed on permanent basis. Please do not forget the funds has to be in GBP.
7)
Alterations & Cancellations :
7.1) Changes : Should you wish
to make an amendment to your booking after it has been confirmed you must advise
us as soon as possible. Whilst we will try to assist you we regret amendment
requests cannot always be met. Where an amendment can be made, the amendment fee
shown below per person/per booking will be payable together with any costs
incurred by ourselves and any costs or charges incurred or imposed by any of the
principals of your arrangements.

7.2) Cancellations : If
you wish to cancel a confirmed booking, you must advise us as soon as possible.
You will have to pay a cancellation charge which will vary depending on the type
of booking you make. If a Cancellation Policy is displayed in red during the
booking process this will overide our standard cancellation charges below. If we
do not display a Cancellation Policy during the booking process, our standard
cancellation charges will apply. The cancallation charge is made up of our fee
and the principal's cancellation charge. Please note that the charge will
increase the closer you get to the departure date, so if you have to cancel,
contact us as early as possible:

7.3) Cancellations or changes made by us or the principle :
If there is a change to or cancellation of your
booking we will pass on the new details as soon as we can. As agent only for the
principal we cannot accept any liability for any changes or cancellations made
to your booking unless they are due our own acts or omissions. However, except
where the change is a result of circumstances outside of the control of the
principal or ourselves (listed in Clause 8 below, ’Circumstances Beyond Our
Control’), for a significant change of accommodation, we will pay compensation
as shown in the table below. A significant change is one which entails a change
to accommodation of a lower official rating and/or a change of resort area. If
you accept the significant change or amend to different accommodation offered
for sale by us you will receive compensation as per Option 1 in the table below.
If you reject the significant change and cancel your booking you will receive
compensation as per Option 2. Compensation payments relating to a child place
for which a child price has been paid are half the amounts shown (up to half the
child price paid). There are no compensation payments payable to those
travelling on ‘free child places’, ‘free group places’ or infants. Compensation
under option 1 applies if the customer accepts the change; option 2 applies if
the customer cancels and receives full refund.

We recommend you take proper insurance cover against the need of changes or cancellations.
8) Complaints Procedure :
If you have a complaint while you are on holiday
you must inform the local representative or agent and the appropriate supplier
immediately who, in turn, must inform our UK office. They will do their best to
resolve the problem to your satisfaction. If you wish to pursue your complaint
on return to the U.K., you must write to our Customer Services Department at our
London office and send the letter by recorded delivery. We regret we cannot, at
any time, accept telephone calls relating to complaints nor can we accept any
complaint received more than 28 days after your return to the U.K. Please note
that compensation and/or refunds, where applicable, will be paid to the person
in whose name the booking was made.
9) Circumstances Beyond Our Control :
Except where otherwise expressly stated in these
conditions, we regret we cannot accept liability or pay any compensation where
the performance or prompt performance of our obligations to you is prevented or
affected by or you otherwise suffer any damage or loss as a result of "force
majeure". In these Booking Conditions, "force majeure" means any event which we
or the principal of the service(s) in question could not, even with all due
care, foresee or avoid. Such events may include war or threat of war, riot,
civil strife, actual or threatened terrorist activity, industrial dispute,
natural or nuclear disaster, adverse weather conditions, fire and all similar
events outside our control. 10) Pricing policy :
All fares and other information displayed on our website are subject to availability. All our prices are from prices and the actual price for the product will be released to the client on receiving an email from the client asking for the price.
11) Behaviour :
It is responsibility of the lead passengerto ensure that you and the members of your party do not behave
in a way which causes offence or danger to others or which risks damage to property
belonging to others. In such circumstances all suppliers (e.g. hotel managers) and the
Company have the right to terminate arrangements made on your behalf, in which case the
Company's responsibility to you ceases immediately and there can be no refunds, no payment
of compensation and no reimbursement of any cost or expenses you may incur as a result.
Further, you will be liable to reimburse the Company for any expenses whatsoever it incurs
as a result of your behaviour.
12) Supplier Policy :
Please note that, as between you and any of the suppliers whose services form part of your
booking, the suppliers' standard terms and conditions will apply. This is particularly
important in the case of "other holiday arrangements" where we act only as a
booking agent between you and the relevant suppliers. The suppliers' standard conditions
may limit or exclude liability, often in accordance with international conventions. Copies
of these conditions may be requested in writing, but up to 28 days must be allowed for
delivery.
13) Special Request :
If you have any special requests (for example
dietary requirements, cots* or room location) please advise us at the time of
booking. We will pass on all such requests to the principal(s) of the
arrangements you have booked, but unfortunately we cannot guarantee that they
will be met. Confirmation that a special request has been noted or passed on to
the principal(s) or the inclusion of the special request on your retail sales
invoice/confirmation or any other documentation is not confirmation that the
request will be met. Unless and until specifically confirmed, all special
requests are subject to availability. Further, if the principal(s) is unable to
meet any such requests, neither we, nor they, will have any liability to you in
this respect. We regret we cannot accept any conditional bookings, i.e. any
booking which is specified to be conditional on the fulfilment of a particular
request. All such bookings will be treated as "standard" bookings subject to the
above provisions on special requests. Please note, cots and other special
requests may only be available at an extra charge unless otherwise expressly
stated in the description of the accommodation/arrangement in question. If you
or any member of your party has any medical problem or disability which may
affect your booking, please tell us before you confirm your booking so that we
can advise as to the suitability of the chosen arrangements. In any event, you
must give full details in writing at the time of booking. If we or the principal
reasonably feel unable to properly accommodate the particular needs of the
person concerned, we must reserve the right on behalf of the principal(s)
concerned to decline their reservation or, if full details are not given at the
time of booking, cancel on behalf of the principal(s) concerned when we become
aware of these details.
14) Final Word : The contract constituted by the Company's acceptance of your booking subject to these
Conditions shall constitute the entire agreement between you and the Company in relation
to the relevant booking, shall exclude all other terms and conditions (except for the
relevant suppliers' conditions and any application international conventions) and shall
supersede all prior or contemporaneous communication or information provided.
